Abstract

The article deals with topical issues of rehabilitation in the criminal trial of Russia. The analysis of the legal functions of the state and its implementation through the institution of decriminalization. We present the position of the Constitutional Court of the Russian Federation, and has made specific proposals for improving the criminal and criminal procedural law in order to restore social justice for those acts which the state recognized as representing a public danger.
